In the first instance, after we have made the first contacts with the heirs and / or their notary. We will request a number of documents in order to open the estate file.
Our office can use the notarial power of attorney to settle the estate file in Spain, which does not require the heirs to move to Spain.
The heirs and / or the notary must provide us with the following information, as far as possible: • Confirm whether the deceased was resident in Spain or inUK • NIE number of the deceased • Copy of multilingual death certificate (to be requested from the municipality of death) • Certificate of succession provided by the Apostille of The Hague - This must subsequently be swornly translated into Spanish. . • Copy of deed of purchase of property (s) in Spain. If car or boat, also information about this property. • Copy of the last annual municipal tax on property (s). The cadastral value is stated on this so that we can calculate the minimum tax value. • Copy of the last invoice of the utilities and data association of owners (syndic) - if applicable. To check whether these should be changed after the holder's deed has been executed. • Details of the heirs for drawing up the bilingual notarial power of attorney.
On the basis of the information provided, we will investigate the real estate in Spain. Checking the title of the property, checking whether there are debts in Spain and valuation of the real estate on the basis of the tax data.
As is done in the UK by the notary, we will consult the Spanish Central Testament Register via Madrid whether or not the deceased had drawn up a Spanish will. We will also contact the bank (s) where the deceased opened his bank account to request the balance certificate on the date of death, as this balance will be part of the estate in Spain.
